Tesla And Staffing Agency Pay Millions In Injury Lawsuit

BY: Koszdin | Friday, May 24, 2019.

When you go to work in Los Angeles, or anywhere in the state, you should never have to worry about an unsafe working environment. However, there are times when employers fail to take the steps necessary to keep workers safe. Today, we want to talk about a recently settled case from a Tesla plant.

At Koszdin, Fields & Sherry, we are here when you need a Los Angeles workplace injuries attorney. Let our team investigate your case and move to secure the compensation you deserve.

What Happened In This Case?

We have learned that a woman who once worked as a janitor as a Tesla factory has been awarded $13 million in a settlement. The case, which was about to go to trial, reached an agreement just after a jury was selected but before opening statements were made.

The incident happened in 2014 when Teodora Tapia was working and the driver of a Tesla car “pinned her between his vehicle and another, and they struck her a second time.”

The driver of the Tesla was a contractor with a separate company.

“As a result of the Defendant’s action, Plaintiff suffered serious and permanent injuries to her lower extremities and body.”

Indeed, Tapia is permanently disabled now. She will never work again.

You may be wondering why the settlement was so high. Wouldn’t workers’ compensation be responsible for covering her injuries and any related expenses?

In most cases, workers’ compensation insurance is responsible for covering work injury costs. However, when a third party causes a person’s injuries, a victim may be eligible for more compensation. That is because the third party may not follow the same rules and safety standards as the main company, increasing the risks a person faces at work.

Workplace injuries are not rare. According to the Bureau of Labor Statistics, there were more than 2.8 million nonfatal workplace injuries during the latest reporting year in the US. It is not uncommon for us to see a wide range of injuries in the workplace that all have various recovery times. One thing we do know is that workers should never be left holding the bills, especially when the negligence of another person or the actions of their employer has caused them harm.
